Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of DailyReps, a web-based habit tracking application operated by NovaPoint AI, LLC ("we," "us," or "our"). By creating an account or using DailyReps, you agree to these Terms. If you do not agree, do not use the service.

2. Eligibility

You must be at least 13 years old to use DailyReps. By using the service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete information when creating your account.
• Keep your login credentials secure and not share them with others.
• Create and maintain only one account per person.
• Notify us immediately at team@dailyreps.pro if you believe your account has been compromised.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Free Trial and Subscription

DailyReps offers a 7-day free trial when you create a new account. No payment information is required to start a trial.

After the trial period ends, continued access to the service requires a paid subscription. If you do not subscribe, your access to the app features will be restricted. Your data will not be deleted immediately upon trial expiry — we will retain it for a reasonable period to allow you to subscribe and recover access.

Subscription pricing, billing frequency, and any refund policy will be disclosed at the time of purchase. All fees are in US dollars unless stated otherwise.

5. Acceptable Use

You agree not to:

• Use DailyReps for any unlawful purpose or in violation of any applicable laws or regulations.
• Scrape, crawl, or systematically extract data from the service without our written permission.
• Attempt to gain unauthorized access to any part of the service, other users' accounts, or our infrastructure.
• Impersonate another person or entity, or misrepresent your affiliation with any person or entity.
• Introduce malware, viruses, or any other harmful code into the service.
• Abuse, harass, or threaten our team or other users.
• Use the service in a way that could damage, disable, or impair its availability or performance.

We reserve the right to suspend or terminate your account for any violation of these acceptable use standards, without prior notice.

6. Intellectual Property

Our content: The DailyReps application, including its design, code, branding, and all content we create, is owned by NovaPoint AI, LLC and protected by applicable intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the application without our written permission.

Your data: The goals, completions, and other content you create within DailyReps belong to you. We do not claim ownership over your personal data. By using the service, you grant us a limited license to store and process your data for the purpose of providing the service to you.

7. Privacy

Your use of DailyReps is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect and use your information.

8. Disclaimer of Warranties

DailyReps is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, secure, or free of bugs or viruses.

We make no warranties regarding the accuracy, reliability, or completeness of any content in the application. Your use of the service is at your sole risk.

9. Limitation of Liability

To the fullest extent permitted by applicable law, NovaPoint AI, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use DailyReps, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from these Terms or your use of the service shall not exceed the greater of (a) the amount you paid us in the 12 months prior to the claim, or (b) $10 USD.

10. Termination

You may terminate your account at any time by contacting us at team@dailyreps.pro. Upon termination, your access to the service will end and your data will be deleted in accordance with our Privacy Policy.

We may terminate or suspend your access at any time, with or without cause and with or without notice, particularly in cases of violation of these Terms. Upon termination by us, we will make reasonable efforts to notify you and provide access to export your data where feasible.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice in the app at least 14 days before the new Terms take effect. Your continued use of DailyReps after the effective date constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable US law.
